Terms of Use — Duskwing

These terms apply to the Duskwing app ("the app"), published by Duskwing Studios ("we," "us," "our"). By using the app, you agree to them. If you don't, please don't use the app.
These terms are in addition to Apple's standard Licensed Application End User License Agreement, which also applies to apps distributed through the App Store.
What the app is
Duskwing is a study aid. It asks practice questions to help you learn, and nothing more.
The app is not an authority on anything. It is not an official, approved, or certified source of aviation information. It is not a substitute for an aircraft's Pilot's Operating Handbook or Flight Manual, for your instructor or training organisation, or for the regulations that apply to you. Never use the app in place of those, and never rely on it for the operation of an aircraft.
- Questions about an aircraft are written from a specific edition of that aircraft's handbook, which the app shows you. Your aircraft may differ, and handbooks are revised.
- Other questions cover general aviation knowledge. Regulations and procedures differ between countries and change over time.
- Always verify anything that matters against your own handbook, your instructor, and the rules that apply where you fly.
Accuracy
We work carefully, but the app may contain errors, and content can become out of date. The app is provided "as is," without warranty of any kind, to the fullest extent the law allows. We don't warrant that the content is accurate, complete, current, or suitable for any particular examination or checkride.
If you find a mistake, please tell us using "Report a problem" in the app or by emailing support@duskwingstudios.com. We're grateful for corrections.
Your responsibility
You are responsible for your own training, your decisions, and the safe operation of any aircraft. Nothing in the app transfers any of that to us.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of the app, from reliance on its content, or from any error or omission in it. This includes indirect and consequential loss. Nothing in these terms limits any liability that cannot be limited by law, and your statutory rights as a consumer are unaffected.
Purchases
- Some of the app's content is available without purchase, as a demo. Full access is available in two ways: a monthly auto-renewing subscription, or a one-time lifetime purchase.
- The lifetime purchase is a single payment that gives you full access on your Apple account, with no renewal. It is not a subscription and there is nothing to cancel.
- If you buy lifetime access while a monthly subscription is active, Apple does not cancel that subscription for you. You need to cancel it yourself in your Apple account settings.
- The price and period are shown in the app before you purchase, and payment is charged to your Apple account at confirmation.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple account settings. Deleting the app does not cancel it.
- Purchases and refunds are handled by Apple under Apple's terms. We can't issue refunds ourselves, but we're happy to help if something has gone wrong.
- If the price changes, Apple will ask for your agreement before the new price applies.
Content and intellectual property
The questions, explanations, images, design, and the app itself belong to Duskwing Studios. You may use them for your own personal study. You may not copy, republish, redistribute, sell, or extract the content, in whole or in part, or use it to build or train another product or service.
Aircraft names and other trademarks mentioned in the app belong to their owners and are used only to describe which aircraft a question relates to. Duskwing is an independent study aid and is not affiliated with, endorsed by, or sponsored by any aircraft manufacturer, aviation authority, or training organisation.
Changes
We may update the app and these terms. Material changes to these terms will be reflected by the "Last updated" date above, and continuing to use the app means you accept them.
Governing law
These terms are governed by the laws of the Republic of Türkiye. If you use the app as a consumer elsewhere, you keep the protections of the mandatory consumer law of your own country.
